2. Eligibility and Account Registration
2.1 Age Requirements
You must be at least 18 years old (or the age of majority in your jurisdiction) to use AHRAS. If you are under 18, you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
AHRAS is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13.
2.2 Account Creation
To access certain features of AHRAS, you must create an account by providing:

- Password (required, unless using third-party authentication)
Alternatively, you may register using:

2.5 One Account Per User
You may only create one account. Creating multiple accounts to circumvent restrictions or gain unfair advantage is prohibited and may result in termination of all your accounts.
2.6 Organizational Accounts
If you create an account on behalf of your employer or organization:
- You represent that you have authority to bind that organization to these Terms
- References to "you" include both you individually and the organization
3. Description of Service
3.1 What AHRAS Does
AHRAS is an AI-powered job description generation platform that:
- Generates professional job descriptions for 12 IT roles (Backend Engineer, Frontend Engineer, Fullstack Engineer, QA Engineer, DevOps Engineer, Mobile Engineer, Data Engineer, Product Manager, Business Analyst, Product Owner, Project Manager, UX/UI Designer)
- Provides three output formats: Full Text, Short Version (LinkedIn), and Teaser (social media)
- Offers customization options: seniority level, technology stack, company information, soft skills, benefits, tone/style
- Stores your generation history in your personal account
- Supports export in 7 formats: Plain Text, Markdown, HTML, PDF, LinkedIn, DOU.ua, HeadHunter
3.2 AI Technology
AHRAS uses artificial intelligence and machine learning models (including third-party services like OpenAI GPT-4) to generate content. The AI:
- Analyzes your inputs (role, seniority, tech stack, company details)
- Applies pre-built templates and domain-specific knowledge
- Generates human-readable job description text
- Adapts tone and style based on your preferences
3.3 Service Availability
We strive to provide 99.9% uptime, but the Service is provided "as is" and "as available." We do not guarantee that:
- The Service will be uninterrupted, timely, secure, or error-free
- AI-generated content will be accurate, complete, or suitable for your specific needs
- Any errors or defects will be corrected
- The Service will meet your requirements or expectations
3.4 Service Modifications
We reserve the right to:
- Modify, suspend, or discontinue any part of the Service at any time
- Add or remove features, roles, or functionality
- Update AI models or change generation algorithms
- Introduce new subscription tiers or pricing
We will provide reasonable notice for material changes affecting your use of the Service.
3.5 Beta Features
We may offer beta, pilot, or experimental features ("Beta Features"). Beta Features:

4. User Responsibilities and Acceptable Use

You may use AHRAS to:

- Create templates for your organization's hiring needs
- Export and publish job descriptions on job boards and your website
- Share generated content with colleagues and team members
- Modify and customize generated content to fit your needs
4.2 Prohibited Uses
You may NOT use AHRAS to:
Illegal Activity:
- Violate any applicable laws, regulations, or legal obligations
- Infringe on intellectual property rights of others
- Engage in fraud, harassment, or unlawful discrimination
Harmful Content:
- Generate content that is discriminatory, hateful, or offensive
- Create job descriptions that violate employment laws or regulations
- Include false, misleading, or deceptive information
System Abuse:
- Reverse engineer, decompile, or disassemble the Service
- Bypass, circumvent, or disable security features or access controls
- Use automated tools (bots, scrapers, scripts) without authorization
- Overload, interfere with, or disrupt the Service infrastructure
- Launch denial-of-service attacks or similar malicious activity
Competitive Use:
- Build a competing service or product using AHRAS
- Scrape, copy, or redistribute our templates or training data
- Use AHRAS to train third-party AI models without permission
Commercial Misuse:
- Resell or sublicense AHRAS to third parties without authorization
- Use AHRAS on behalf of multiple organizations under a single account
- Share accounts or credentials with unauthorized users
4.3 Content Standards
All content you input into AHRAS (company descriptions, benefits, custom text) must:
- Be truthful and accurate
- Comply with employment and anti-discrimination laws
- Not contain sensitive personal information of others
- Not infringe on trademarks, copyrights, or other intellectual property
- Be appropriate for a professional recruitment context
4.4 Compliance with Laws
You are responsible for ensuring that:
- Your use of AHRAS complies with all applicable laws in your jurisdiction
- Generated job descriptions comply with local employment laws
- You have necessary rights to use company information and branding
- Your hiring practices do not violate anti-discrimination regulations
Examples of laws that may apply:
- Equal Employment Opportunity (EEO) laws
- Americans with Disabilities Act (ADA)
- General Data Protection Regulation (GDPR)
- California Consumer Privacy Act (CCPA)
- Local labor and employment regulations
4.5 Monitoring and Enforcement
We reserve the right to:
- Monitor usage patterns for abuse or violations
- Investigate suspected violations of these Terms
- Remove or disable content that violates these Terms
- Suspend or terminate accounts for policy violations
- Report illegal activity to law enforcement authorities
We are not obligated to monitor user content, but we may do so to ensure compliance with these Terms and applicable laws.
5. AI-Generated Content and Intellectual Property
5.1 Ownership of Generated Content
You Own the Output: You retain full ownership of AI-generated job descriptions created through AHRAS, subject to the following:
- You may use, modify, distribute, and publish the content as you see fit
- You may incorporate the content into your recruitment materials
- You may share the content with colleagues, job boards, and applicants
- You are responsible for reviewing and ensuring the content's suitability
Our Rights: We retain the right to:
- Use anonymized, aggregated data from generations to improve the Service
- Analyze generation patterns for service optimization
- Display usage statistics (e.g., "80% of users generate Backend Engineer roles")
- Reference your use of AHRAS in case studies or testimonials (with your consent)
5.2 License to Use Your Inputs
By submitting content (company name, benefits, custom text) to AHRAS, you grant us a worldwide, non-exclusive, royalty-free license to:
- Process your inputs through our AI models
- Store your inputs in your account
- Use anonymized, aggregated patterns for service improvement
This license terminates when you delete content from your account, except for anonymized data used for analytics.
5.3 Intellectual Property Rights
AHRAS Trademarks and Branding:
- "AHRAS," "AutoVacancy," logos, and branding are trademarks of STVIGA LLC
- You may not use our trademarks without prior written permission
- You may not misrepresent your affiliation with AHRAS
Underlying Technology:
- All software, algorithms, templates, and AI models are proprietary to STVIGA LLC or our licensors
- You do not acquire any rights to our technology or codebase
Third-Party AI Providers:
- We use third-party AI services (e.g., OpenAI GPT-4) subject to their terms
- Your inputs may be processed by these providers according to their policies
- We do not grant you any rights in third-party technologies
5.4 Content Accuracy and Liability
No Warranty on AI Content: AI-generated job descriptions:
- Are created based on your inputs and our templates
- May contain errors, biases, or inaccuracies
- Should be reviewed and edited before publication
- Are not guaranteed to comply with all employment laws
- May not be suitable for all industries or jurisdictions
Your Responsibility: You are solely responsible for:
- Reviewing generated content for accuracy and appropriateness
- Ensuring compliance with employment laws and regulations
- Verifying that content reflects your company's actual policies
- Editing content to match your specific needs and culture
No Legal Advice: AHRAS does not provide legal, HR, or compliance advice. Generated content is not a substitute for professional counsel.
5.5 Feedback and Suggestions
If you provide feedback, suggestions, or ideas about AHRAS:
- We may use your feedback without obligation or compensation
- You grant us a perpetual, irrevocable license to implement your suggestions
- We are not required to keep your feedback confidential
6. Subscription Plans and Payment
6.1 Free Tier
AHRAS currently offers a free tier with:
- Unlimited job description generation
- Access to all 12 roles
- All 3 output formats (Full, Short, Teaser)
- Storage of generation history
- Export in 7 formats
Free Tier Limitations:
- Subject to fair use policies
- May be throttled or rate-limited during high traffic
- May include usage limits in the future (with advance notice)
6.2 Paid Plans (Future)
We may introduce paid subscription plans in the future. If we do:
- Advance Notice: We will provide at least 30 days' notice before transitioning free features to paid tiers
- Grandfathering: Existing users may be grandfathered into certain features at no cost
- Transparent Pricing: Pricing will be clearly displayed on our website
- Billing Cycle: Subscriptions may be monthly or annual, with automatic renewal
6.3 Payment Terms (When Applicable)
If you subscribe to a paid plan:
Payment Authorization:
- You authorize us to charge your payment method for subscription fees

- We do not store your full credit card details
Automatic Renewal:
- Subscriptions renew automatically unless you cancel

- Generated content will remain in your account (subject to data retention policies)
6.5 Taxes
You are responsible for all applicable taxes (VAT, GST, sales tax) in your jurisdiction. Taxes may be added to your subscription fees where required by law.
7. Data Privacy and Security

Your use of AHRAS is governed by our Privacy Policy, which describes:

By using AHRAS, you consent to our Privacy Policy.

- Security or safety of third-party services
Your use of third-party services is governed by their respective terms and privacy policies.
8.5 No Endorsement
Links to third-party services do not constitute endorsement. We do not guarantee the quality, accuracy, or reliability of third-party content or services.
9. Disclaimers and Limitations of Liability
9.1 Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, AHRAS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
No Warranty of Accuracy:
- We do not warrant that AI-generated content is accurate, complete, or error-free
- We do not guarantee that content complies with employment laws in your jurisdiction
- We do not warrant that content is suitable for your specific needs
No Warranty of Service Availability:
- We do not guarantee that the Service will be uninterrupted, timely, or secure
- We do not warrant that defects will be corrected
- We do not guarantee compatibility with all devices or browsers
No Warranty of Fitness for Purpose:
- We do not warrant that AHRAS will meet your requirements
- We do not guarantee specific results or outcomes from using the Service
- We do not warrant that AI models will perform as expected
No Implied Warranties:
- All implied warranties of merchantability, fitness for a particular purpose, and non-infringement are disclaimed
9.2 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, STVIGA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
Indirect Damages:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Loss of goodwill or reputation
- Cost of substitute services
Direct Damages Cap:
- In no event shall our total liability exceed the greater of:
- (a) $100 USD, or
- (b) The amount you paid to AHRAS in the 12 months preceding the claim
Excluded Liability:

- Damages from service interruptions, data loss, or security breaches

You acknowledge and agree that:

- You are solely responsible for reviewing and editing content before publication
- You assume all risks associated with using AI-generated job descriptions
- AHRAS is not a substitute for professional HR, legal, or compliance advice

9.4 No Professional Services
AHRAS does not provide:
- Legal advice or representation
- HR consulting or employment law guidance
- Recruitment services or candidate sourcing
- Guarantee of hiring success or candidate quality
9.5 Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including:
- Natural disasters (earthquakes, floods, fires)
- War, terrorism, or civil unrest
- Government actions or regulations
- Internet outages or telecommunications failures
- Third-party service provider outages (AI providers, cloud hosting)
- Pandemics or public health emergencies
10. Indemnification
10.1 Your Indemnification Obligation
You agree to indemnify, defend, and hold harmless STVIGA LLC, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
Your Use of the Service:
- Your violation of these Terms
- Your violation of any law or regulation
- Your violation of any third-party rights (intellectual property, privacy, etc.)
Your Content:
- Content you submit to AHRAS (company information, custom text)
- Your use of AI-generated content (publishing job descriptions)
- False, misleading, or discriminatory information in your job descriptions
- Employment practices resulting from your use of generated content
Account Misuse:
- Unauthorized access to your account by third parties due to your failure to secure credentials
- Sharing your account with unauthorized users
- Creating multiple accounts or circumventing restrictions
Third-Party Claims:
- Claims by job applicants, employees, or contractors related to your job descriptions
- Claims by competitors or other third parties arising from your use of AHRAS
10.2 Defense and Settlement
If we are subject to a claim covered by your indemnification obligation:
- We will notify you of the claim
- We may participate in the defense at our own expense
- You will not settle any claim without our prior written consent
- We reserve the right to assume exclusive defense and control of any matter subject to indemnification
11. Termination and Suspension
11.1 Termination by You
You may terminate your account at any time:
How to Terminate:

Effect of Termination:
- Your access to the Service will end immediately
- Your personal information will be deleted within 30 days (subject to legal retention)
- Generated job descriptions will be deleted immediately
- Subscription fees are non-refundable (no pro-rata refunds for early termination)
Post-Termination Rights:
- You may continue to use AI-generated content you exported before termination
- You may not access the Service or create a new account without our permission (if terminated for cause)
11.2 Termination or Suspension by Us
We may suspend or terminate your account immediately if:
Violation of Terms:
- You violate these Terms or our Acceptable Use Policy
- You engage in fraudulent, abusive, or illegal activity
- You pose a security risk to the Service or other users
Non-Payment:
- You fail to pay subscription fees when due
- Your payment method is declined or invalid
- You engage in chargebacks or payment disputes
Inactivity:
- Your account is inactive for 24+ months (we will notify you before deletion)
Legal or Regulatory Reasons:
- We are required to terminate access by law or court order
- We need to comply with legal or regulatory obligations
At Our Discretion:
- We may terminate accounts for any reason with 30 days' notice
Effect of Suspension:
- Temporary suspension restricts access but does not delete data
- You may restore access by resolving the issue (e.g., updating payment method)
Effect of Termination:
- Your account and data will be deleted according to our data retention policies
- You will not be refunded for unused subscription time
- You may not create a new account without our permission
11.3 Survival
The following provisions survive termination:

- Indemnification obligations

12. Dispute Resolution and Governing Law
12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of:
- United States: Federal laws and the laws of the State of New Mexico
- For EU/EEA users: EU law and the law of Lithuania apply where relevant
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
12.2 Jurisdiction and Venue
For users in the United States:
- Exclusive Jurisdiction: Federal and state courts located in New Mexico, USA
- Consent to Jurisdiction: You consent to personal jurisdiction in these courts
- Waiver of Objection: You waive any objection to venue or inconvenient forum
For users in the European Union:
- EU Consumer Rights: EU consumers may bring claims in their country of residence
- Competent Authority: Disputes may be submitted to relevant consumer protection authorities
12.3 Informal Dispute Resolution
Before filing a formal claim, you agree to:

- Good Faith Negotiation: Engage in good faith negotiations for 30 days
- Escalation: If unresolved, either party may proceed with formal dispute resolution
12.4 Arbitration Agreement (US Users Only)
Mandatory Arbitration:
For users in the United States, you and STVIGA LLC agree to resolve disputes through binding arbitration instead of court, except for:
- Small claims court actions (claims under $10,000)
- Injunctive relief to protect intellectual property
- Claims that cannot be arbitrated under applicable law
Arbitration Rules:
- Governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.)
- Administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules
- Conducted via video conference or in-person in New Mexico
Arbitration Costs:
- Each party pays its own attorneys' fees and costs
- AAA filing fees are split equally, unless the arbitrator orders otherwise
Class Action Waiver:
- You waive the right to participate in class actions, class arbitrations, or representative actions
- Disputes must be brought individually, not as a class member
- The arbitrator may not consolidate multiple parties' claims
Opt-Out Right:
- You may opt out of arbitration by emailing support@stviga.com within 30 days of accepting these Terms
- Opt-out email must state: "I opt out of arbitration"
- If you opt out, disputes will be resolved in court (Section 12.2)
12.5 Limitation Period for Claims
Any claim arising from these Terms or your use of AHRAS must be filed within one (1) year of the date the claim arose. After one year, the claim is permanently barred.

- Address security or technical issues

14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and STVIGA LLC regarding AHRAS. They supersede all prior agreements, understandings, or communications.
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable:
- That provision will be limited or eliminated to the minimum extent necessary
- The remaining provisions will remain in full force and effect
- We may replace the invalid provision with a valid one that achieves the same purpose
14.3 Waiver
